Agreement to Terms

These Terms of Use form a legally binding agreement between you, either individually or on behalf of an entity (“you”), and essay-extender.net (“Company,” “we,” “us,” or “our”), governing your access to and use of the Essay Extender website, along with any related media channels, mobile websites, or mobile applications (collectively referred to as the “Site”). By accessing the Site, you confirm that you have read, understood, and agree to comply with all of these Terms of Use. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND MUST IMMEDIATELY DISCONTINUE YOUR USE.

Supplementary terms or documents may be posted on the Site from time to time and are incorporated by reference into these Terms of Use. We reserve the right to modify or update these Terms at any time, at our sole discretion. Any changes will be indicated by updating the “Last updated” date of these Terms. By continuing to use the Site after such changes are posted, you accept and agree to the updated Terms of Use.

The information on the Site is not intended for use or distribution by any individual or entity in jurisdictions where such use or distribution would be prohibited by law or regulation. If you access the Site from other locations, you do so at your own risk and are solely responsible for ensuring compliance with local laws, as applicable.

Intellectual Property Rights

User Representations

By using the Site, you represent and warrant that:

You are not a minor in the jurisdiction where you reside.

You will not use the Site for any unlawful or unauthorized purpose.
Your use of the Site will not violate any applicable laws or regulations.

If any information you provide is found to be false, inaccurate, outdated, or incomplete, we reserve the right to suspend or terminate your account and refuse any current or future access to the Site (or any part of it).

Prohibited Activities

You are prohibited from using the Site for any purpose other than those explicitly provided by us. The Site may not be used for any commercial purposes unless specifically endorsed or approved by us.

Copying or adapting the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code is not allowed. You must not reverse engineer, decompile, or disassemble any part of the Site’s software, unless permitted by applicable law.
Automated systems like spiders, robots, or unauthorized scripts designed to access the Site are prohibited. Using a buying agent or making unauthorized purchases on the Site is also not allowed. Additionally, you may not collect usernames or email addresses for unsolicited communications, nor create accounts through automated means or under false pretenses.
Finally, you are prohibited from using the Site for any competitive purposes or to generate revenue or commercial enterprise without our authorization.

User-Generated Contributions

The Site does not currently offer users the ability to submit or post content. However, we may provide opportunities for you to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site. These contributions may include text, writings, video, audio, photographs, graphics, comments, suggestions, personal information, or other materials (collectively referred to as “Contributions”). Such Contributions may be visible to other users of the Site and through third-party websites. Accordingly, any Contributions you submit may be governed by our Site’s Privacy Policy.

By submitting any Contributions, you represent and warrant that:

The creation, distribution, transmission, public display, performance, accessing, downloading, or copying of your Contributions does not and will not infringe upon the proprietary rights of any third party, including but not limited to copyright, patent, trademark, trade secret, or moral rights.
You are the creator and owner of, or have the necessary licenses, rights, consents, releases, and permissions to use and authorize us, the Site, and other users to use your Contributions in the manner contemplated by the Site and these Terms of Use.
You have the written consent, release, and/or permission from each identifiable individual featured in your Contributions to use their name or likeness, enabling inclusion and use of your Contributions as intended by the Site and these Terms of Use.
Your Contributions are not false, inaccurate, or misleading.
Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or any other form of solicitation.
Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable, as determined by us.
Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
Your Contributions are not intended to harass, threaten, or promote violence against any person or group.
Your Contributions do not violate any applicable laws, regulations, or rules.
Your Contributions do not violate any third-party privacy or publicity rights.
Your Contributions do not involve or promote child pornography or any materials that jeopardize the health or well-being of minors.
Your Contributions do not contain offensive comments relating to race, national origin, gender, sexual preference, or physical disability.
Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Use or any applicable laws or regulations.

Any violation of these guidelines may result in the termination or suspension of your rights to use the Site.

Contribution License

By using the Site, you agree that we may access, store, process, and use any information or personal data you provide in accordance with the terms outlined in our Privacy Policy and your selected preferences (including settings).

When you submit suggestions or feedback about the Site, you agree that we may use and share this feedback for any purpose without providing compensation to you.

We do not claim ownership of your Contributions. You retain full ownership of your Contributions and any associated intellectual property or other proprietary rights. We are not responsible for any statements or representations made in your Contributions on the Site. You are solely responsible for the content of your Contributions and agree to release us from any liability, waiving any legal claims related to your Contributions.

Submissions

You acknowledge that any questions, comments, suggestions, ideas, feedback, or other information you provide regarding the Site (collectively, “Submissions”) are non-confidential and will become our exclusive property. We will hold all rights to these Submissions, including all intellectual property rights, and may use and distribute them without restriction, for any lawful purpose, commercial or otherwise, without compensation or acknowledgment to you. By submitting these materials, you waive any moral rights to them and confirm that they are original or that you have the necessary rights to submit them. You further agree not to hold us liable for any actual or alleged infringement of proprietary rights in your Submissions.

Term and Termination

These Terms of Use will remain in effect as long as you use the Site. Without limiting any other provisions of these Terms of Use, we reserve the right, at our sole discretion and without notice or liability, to deny access to and use of the Site (including blocking certain IP addresses) to anyone, for any reason or no reason, including but not limited to a breach of any representation, warranty, or covenant in these Terms of Use or any applicable law or regulation. We may terminate your access to the Site or delete any content or information you have posted at any time, without warning, at our sole discretion.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake name, a borrowed name, or the name of any third party, even if you are acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including civil, criminal, or injunctive action without limitation.

Modifications and Interruptions

We reserve the right to change, modify, or remove the content of the Site at any time, at our sole discretion, without notice. However, we have no obligation to update any information on the Site. We also reserve the right to modify or discontinue all or part of the Site without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.

We will not be involved in or responsible for monitoring any transactions between you and third-party providers of products or services. Limitations of Liability

Notwithstanding the above, at your expense, we reserve the right to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will make reasonable efforts to notify you of any claim, action, or proceeding subject to this indemnification upon becoming aware of it.

Governing Law

The laws of the country, excluding its conflicts of law rules, shall govern these Terms and your use of the Service. Your use of the application may also be subject to other local, state, national, or international laws.

Dispute Resolution

If you have any concerns or disputes about the Service, you agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you reside.

United States Legal Compliance

You represent and warrant that:

You are not located in a country that is subject to the United States government embargo, nor is the United States government designating it as a “terrorist supporting” country,
You are not listed on any United States government list of prohibited or restricted parties.

User Data

We will maintain certain data you transmit to the Site to manage its performance and data related to your use of the Site. Although we perform regular routine backups, you are solely responsible for all data you transmit or any activity you undertake using the Site. You agree that we shall have no liability for any loss or corruption of such data, and you waive any right of action against us arising from such loss or corruption.

Electronic Communications, Transactions, and Signatures

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. Our failure to exercise or enforce any right or provision of these Terms of Use shall not waive that right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We are not responsible for any loss, damage, delay, or failure to act caused by events beyond our reasonable control. If any provision or part of a provision is deemed unlawful, void, or unenforceable, it is severable from these Terms of Use and does not affect the validity and enforceability of the remaining provisions. No joint venture, partnership, employment, or agency relationship is created between you and us due to these Terms of Use or use of the Site. You agree that these Terms of Use will not be construed against us because we drafted them. You waive any defenses based on the electronic form of these Terms of Use and the lack of signatures.
